Acceptance of Terms

By using the website located at mankatofenceanddeck.com or by contacting, scheduling, or engaging Mankato Fence & Deck for any service, you agree to these Terms and Conditions. If you do not agree, please do not use this website or engage our services.

Description of Services

Mankato Fence & Deck provides residential deck construction, fence installation, deck repair, and related outdoor structure services in Mankato, MN and surrounding communities.

All services are performed by or under the supervision of Mankato Fence & Deck personnel. We reserve the right to decline any project that is outside our service area, beyond our scope of work, or that we cannot complete to our standards.

Estimates and Pricing

All written estimates provided by Mankato Fence & Deck:

• Are based on the site conditions and project details observed or described at the time of estimate
• Are valid for 30 days from the date of issue unless otherwise noted in writing
• Are not final quotes until a written contract is signed by both parties

If site conditions, customer-requested changes, or unforeseen circumstances (such as hidden rot, unstable soil, or utility conflicts) require additional work beyond the original scope, we will notify you in writing before proceeding. Additional work beyond the original scope will be billed at our current rates and requires your written approval before we begin.

Verbal estimates are not binding. Only written, signed estimates constitute a commitment on our part.

Scheduling and Cancellations

Project scheduling is subject to contractor availability, permit timelines, weather conditions, and material lead times.

• We will provide you with a start date range once a contract is signed and any required deposit is received.
• Start dates may shift due to weather, prior project delays, or permit processing times. We will communicate changes as soon as we are aware of them.
• If you need to cancel or postpone a scheduled project, notify us in writing as soon as possible. Cancellation terms specific to your project will be outlined in your written contract.
• If we are unable to begin work within the agreed window due to circumstances within our control, we will work with you to reschedule or refund any deposit paid.

Payment Terms

Payment schedules are specified in each project contract. General terms include:

• A deposit may be required before work begins. The deposit amount will be stated in the written contract.
• Progress payments may be required at defined project milestones for larger projects.
• Final payment is due upon project completion and your acceptance of the finished work.
• Invoices not paid within 30 days of the due date may be subject to a late fee as outlined in your contract.

We accept payment by check, bank transfer, or other methods noted in your contract. We do not accept payment contingent on financing approval unless agreed to in writing in advance.

Permits and Code Compliance

For projects requiring a building permit, Mankato Fence & Deck will pull the required permit from the applicable jurisdiction on your behalf before work begins. The cost of any required permits is included in or added to the project estimate and will be itemized.

All work performed by Mankato Fence & Deck is intended to meet applicable local, state, and building code requirements in effect at the time of construction. It is the property owner's responsibility to inform us of any known easements, deed restrictions, or HOA rules that may affect the project before work begins.

Warranty

Mankato Fence & Deck warrants that all labor and workmanship will be free from defects for a period of one year from the date of project completion. This warranty covers defects in construction that arise from our work and are not caused by:

• Normal wear and tear or weathering
• Customer-supplied materials or customer-directed design choices
• Damage caused by misuse, neglect, or third parties after completion
• Acts of nature, including but not limited to flooding, wind damage, or ice events

Material warranties are provided by the respective manufacturers and are separate from our labor warranty. We will provide you with applicable manufacturer warranty documentation at project completion.

This warranty is your exclusive remedy for workmanship defects. We make no other express warranties. Implied warranties, including implied warranties of merchantability or fitness for a particular purpose, are disclaimed to the fullest extent permitted by law.

Limitation of Liability

To the fullest extent permitted by applicable law, Mankato Fence & Deck's total liability to you for any claim arising from or related to our services or this website is limited to the amount you paid us for the specific project giving rise to the claim.

We are not liable for any indirect, incidental, consequential, or punitive damages, including loss of use, loss of income, or damage to property not directly caused by our work, even if we have been advised of the possibility of such damages.

Website Use

Dispute Resolution

If we cannot resolve the dispute informally, both parties agree to attempt mediation before pursuing any legal action. Mediation will be conducted in Mankato, MN unless both parties agree otherwise in writing.

Governing Law

These Terms and Conditions are governed by the laws of the State of Minnesota, without regard to conflict of law principles. Any legal action not resolved through mediation will be brought in the appropriate state or federal court located in Minnesota.
